Right of Withdrawal

INFORMATION ABOUT THE RIGHT OF WITHDRAWAL FOR DISTANCE CONTRACTS FOR CONSUMERS

Right of Withdrawal for Consumers:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, takes possession of the last item.

by means of an unambiguous statement (e.g., a letter sent by post or an email) about your decision to withdraw from this contract. You can use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your decision to exercise the right of withdrawal before the withdrawal period expires.

For installment contracts:

You can withdraw from your contract within 14 days without giving any reason. The period begins after the conclusion of the contract, but only after you have received all mandatory information according to Section 492, Paragraph 2 of the German Civil Code (e.g., information about the type of loan, the net loan amount (cash price), the contract term). You have received all mandatory information when they are included in the version of your application or contract document intended for you, and such a document has been provided to you. If mandatory information is not included in the contract text, you will be informed later on a durable medium. The withdrawal period then extends to one month. You must be informed again about the start of the withdrawal period after receiving the missing information. To meet the withdrawal deadline, it is sufficient to send the withdrawal statement in time if the statement is made on a durable medium (e.g., letter, fax, email).

Consequences of Withdrawal:

If you withdraw from this contract, we will refund all payments we have received from you, including the cost of delivery (except for the additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we receive the notification of your withdrawal from this contract. We will use the same payment method for the refund as you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods without undue delay and in any case no later than fourteen days from the day you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We will bear the costs of returning the goods, except for returns that need to be shipped via freight.

You will only be liable for any diminished value of the goods if the loss in value is due to handling them in a way that was not necessary to establish the nature, characteristics, and functioning of the goods.

For installment contracts:

If you have already entered into an installment agreement, you must withdraw from the agreement within 30 days at the latest and pay the agreed interest for the period between the conclusion of the contract and the withdrawal statement. The period begins with the submission of the withdrawal statement. For the period between the conclusion of the contract and the withdrawal statement, if the installment agreement is fully used, you must pay a daily interest of 0.25 euros. This amount will be reduced if the installment agreement is only partially used.

You will bear the direct costs of returning the goods.

Exclusion of the Right of Withdrawal:

The right of withdrawal does not apply to:

• Delivery of goods that are not pre-made and for which the consumer’s individual choice or specification is essential, or which are clearly tailored to the personal needs of the consumer

• Delivery of sealed goods that are not suitable for return for health or hygiene reasons if the seal has been removed after delivery

• Delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery

• Delivery of newspapers, magazines, or illustrated magazines, except for subscription contracts.

• Delivery of software licenses/codes (delivered by email)

You can download a model withdrawal form as a PDF (Adobe Acrobat Reader required) and use it to exercise your right of withdrawal. Simply send the completed withdrawal form by post or email to us.

Important Disposal Notice for Batteries and Accumulators:

Every consumer is legally obligated under the German Battery Ordinance to return all used batteries or accumulators. Disposal via household waste is prohibited. Used batteries and accumulators can be returned free of charge at public collection points in the municipality, at our retail store (address below), and anywhere batteries and accumulators of the type in question are sold.

You are thus making a significant contribution to environmental protection!
Polluting batteries or accumulators are marked with the following symbols to indicate the ban on disposal via household waste. The symbol indicates the chemical symbol for the hazardous substance:

Battery contains Cadmium
Battery contains Mercury
Battery contains Lead

Notice according to the Packaging Ordinance:

We are obligated under the Packaging Ordinance to take back packaging of our products that do not bear the symbol of a nationwide disposal system (such as the Green Dot of the Duales System Deutschland AG) and ensure their reuse or disposal.

We will provide you with a municipal collection point or a disposal company in your area that accepts the packaging free of charge. If this is not possible, you have the option of sending the packaging back to us:

We will reuse the packaging or dispose of it according to the Packaging Ordinance.

We are a licensee of the dual system, so it is no longer necessary to return packaging placed on the market by us after January 1, 2009. You can dispose of this packaging through the dual system, such as at public return points like paper and glass containers or the “Yellow Sack” and/or the “Yellow/Blue Bin.” All packaging we placed on the market before January 1, 2009, that is not marked with a symbol of a nationwide disposal system (the "Green Dot") can be sent back to us at our expense.
