INFORMATION ON THE RIGHT OF WITHDRAWAL FOR CONSUMERS IN DISTANCE CONTRACTS

Right of withdrawal for consumers:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period at Peakhouse Audio is fourteen days from the day you or a third party named by you, who is not the carrier, takes possession of the last item.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g., a letter sent by post or e-mail) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

In case of installment purchase agreements:

You can withdraw from your contractual declaration within 14 days without giving any reasons. The period begins after conclusion of the contract, but only after you have received all mandatory information according to § 492 paragraph 2 BGB (e.g., information about the type of loan, net loan amount, contract duration). You have received all mandatory information if they are contained in the copy of your application or the contract document intended for you and you have been provided with such a document. Information not included in the contract text can be provided later on a durable medium; in that case, the withdrawal period is one month. You will be informed again about the start of the withdrawal period when the missing information is provided. To comply with the withdrawal period, timely dispatch of the withdrawal declaration is sufficient if the declaration is made on a durable medium (e.g., letter, fax, email).

Consequences of withdrawal:

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day we receive the notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods without delay and in any event no later than fourteen days from the day you inform us about your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days expires. We will bear the costs of returning the goods, except for returns that must be shipped via freight. Customers within the EU but outside Germany bear the costs of return shipping.

You only have to pay for any diminished value of the goods if the reduction in value is due to handling the goods beyond what is necessary to check their nature, characteristics, and functioning.

Exclusion of the right of withdrawal:

The right of withdrawal does not apply to:

• Delivery of goods that are not prefabricated and for which an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

• Delivery of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal was removed after delivery.

• Delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.

• Delivery of newspapers, magazines, or periodicals except for subscription contracts.

• Delivery of software licenses/codes (delivered by e-mail).

Important disposal instructions for batteries and accumulators:

According to the German Battery Ordinance, every consumer is legally obliged to return all used and spent batteries and accumulators. Disposal via household waste is prohibited. Old batteries and accumulators can be returned free of charge to public collection points in the community, in our specialty store (address below), and wherever batteries and accumulators of the respective type are sold.

Batteries or accumulators containing hazardous substances are marked with the following symbols to indicate the prohibition of disposal in household waste. Below the symbol is the chemical symbol for the heavy metal contained:

Note according to the Packaging Ordinance:

We are obliged by the Packaging Ordinance to take back packaging of our products that do not bear the symbol of a system for comprehensive disposal (e.g., the Green Dot of Duales System Deutschland AG) and to ensure their reuse or disposal.

We will then inform you of a local collection point or a disposal company in your area that accepts the packaging free of charge. If this is not possible, you can send the packaging to us:

The packaging will be reused or disposed of according to the Packaging Ordinance.

We are a licensee of the dual system, so it is no longer necessary to send packaging placed on the market by us after 01.01.2009 back to us. You can dispose of such packaging via the dual system, e.g., through public collection points like paper and glass recycling bins or the “Yellow Sack” and/or “Yellow/Blue Bin.” Any packaging we placed on the market before 01.01.2009 and that is not marked with any comprehensive disposal system symbol (like the “Green Dot”) can be returned to us at our expense.
